Updates About Penn State Scandal UPDATED 6/12: PSU has spent $45.9M on scandal

Well, it's done. The NCAA has seemingly overstepped its authority, but since PSU has signed off, there will be no appeal. The NCAA has now, via precedent, taken authority over immoral behavior. The question now is, where will they strike next? If a school has too many DWI's among athletes, do they put the school on probation? How about shoplifting? As I stated in an earlier post, division I administrators can now wash their hands of the responsibility for overseeing decent behavior on the part of big time coaches. Think the President of Alabama wants to suspend his head football coach? Not if he wants to keep his job (and I'm not suggesting that Sabin has done anything that warrants suspension).

Now let's see what happens at Miami! I wouldn't b a bit surprised if a group of schools drops out to form a super conference of semi-pro football & basketball teams.

You do understand that they were not sanctioning PSU for Sandusky's actions, right?

People seem to have a hard time grasping the fact that the NCAA is a member organization, not unlike a student organization. They have the right to punish members in whatever ways they see fit and their executive committee can interpret their rules in whatever way they see fit.

It is like a fraternity punishing a member so that they cannot attend social functions or must do a required amount of study hours. The Wisconsin band punished members and weren't able to play at games for their hazing incident in 2008. I think of this as similar authority. The NCAA is also a 501 (c) 3 non-profit.

Yes it is a member organization, but if you have a football team and want to play games against other college team, you have to join or you are SOL.

(P.S. People don't argue with me because I "never have a clue". It's because I'm almost always right, and people don't like being told when they're wrong. They often lash out when told/proven to be so. This thread being a perfect case study.)

An interview with an anonymous member of Louis Freeh's investigative group disagrees with the NCAA using the report as the main basis for their punishment.

Some choice quotes:

"The Freeh team reviewed how Penn State operated, not how they worked within the NCAA's system. The NCAA's job is to investigate whether Penn State broke its rules and whether it gained a competitive advantage in doing so."

"The NCAA took this report and ran with it without further exploration. If you really wanted to show there was a nexus to cover up, interview the coaches. See their knowledge and culpability and how far this went."

The NCAA's approach is not sitting well with the source close to Mr. Freeh's staff.

"The sanctions against Penn State were really overwhelming, and no one imagined the report being used to do that. People thought it would help others draw conclusions about what happened and provide a guide for leaders to be able to identify minefields and navigate through them.

"Instead, Emmert took the report and used Penn State's own resources to do them in. The institution is made of people, too. And they don't deserve this."

Sandusky contacted "shower victim" two months before charges, basically wanted to go on a date...nice.

Any lawyers who know how this works? It sounds a bit like a derivative suit where a shareholder sues against the wishes of management and the board. Usually, I believe there is a high bar for this type of action.
