Maybe Kolstad should have been HOME with his pregnant wife and kid and not out at the bar past 2 a.m. Let's not act like that's ok either if you're going to the "wife and kid" statement.

My father, who is a retired cop, always said, "Nothing good happens after midnight". Just giving you another side of the argument.

There's no excusing Nelson's actions. The tape shows him walking out of the frame, approaching Kolstad (who was on the ground), and kicking him in the head. I suppose he can argue heat of the moment and I don't know how much time had elapsed throughout the episode, but Kolstad was down and Nelson kicked him. I hope all the people milling around feel proud of themselves for not getting between Nelson and Kolstad.

But e.bigelow, your thoughts are the same as mine and I posted them back about 35-40 pages ago only to be derided as some bluenose who doesn't understand that Kolstad needed to be out with his "boys" knocking back a few. I'm not saying he got what he deserved, because no one deserves being attacked while incapacitated. But your father is right. Nothing good happens after midnight and when you add liquor to the mix, the likelihood of bad things happening increases.

And let's not forget that Nelson was drinking while underage.

This is just a bad scene all around. Glad to hear Kolstad is doing better. He has a long road back, but it appears he's making some progress.

Where did you see this tape? I thought the tape was still being withheld? I know they released tape of immediately after the incident, but was not aware they'd released the actual punch, punch & kick?

In the first paragraph on the third page of the criminal complaint you can read a summary of the surveillance tape. To my knowledge, it hasn't been made public or leaked.

Regardless, it's very interesting to read this. It's really ugly, but it doesn't change my opinion much. Two tough-guy jocks were being idiots outside a bar. Kolstad got hurt badly because he escalated the argument to a fight with his cheap shot & because Nelson kicked a defenseless man. Lot's of ugly to go around here.

Of note:

- Nelson was being a jealous twat.

- Kolstad was actively participating in a heated argument with Nelson, not trying to defuse it or avoid trouble. Kolstad's buddy S.T. said it was unclear if Nelson's accusation of kissing his girlfriend was directed at I.K. or not, but mentioned I.K. "Easily became defensive".

- Kolstad drew fist blood according to the police officer who viewed the tape: "He observed Nelson & S.T. (Kolstad's buddy) had their backs to the North, and M.V. (Nelson's girlfriend) all had her back (sic) to the East. All three are talking when I.K. runs toward the group and as he neared Nelson, I.K. raised his arm and struck Nelson in the back area with a punch. The force of the punch caused Nelson to move into S.T. and both Nelson and S.T. fall to the ground.

- The police officer also notes that after the unknown suspect (Trevor Shelley) punches I.K. he "immediately goes limp and collapses to the pavement". This (along with the eyewitness accounts of the "splat" when Kolstad hit his head on the pavement) seems to support the fact that Kolstad was already injured pretty badly at this point.

- "The unknown suspect stands near I.K for a moment as Nelson closes in on I.K.". The police officer makes it all sound instantaneous, with no delay in the action.

- The police officer also states that "the video clearly shows I.K was defenseless as Nelson delivers the kick, or kicks to the head.". That's not good.

- Lot's of lies included as well of course. Nelson said he didn't recall kicking Kolstad at all (ahem) & didn't know Trevor Shelley (ahem, ahem), while S.T. described Kolstad's punch as a "non fighting punch", which doesn't make any sense or jive with the police officers account.
 

- "The unknown suspect stands near I.K for a moment as Nelson closes in on I.K.". The police officer makes it all sound instantaneous, with no delay in the action.

It does mention that Nelson had to push past others, as well as his girlfriend who was attempting to hold him back. I don't think I'd call that instantaneous, but I don't doubt it happened very quickly.

Regardless, it's very interesting to read this. It's really ugly, but it doesn't change my opinion much.

Since common sense, human decency, logic, & law don't - I'm not surprised this read doesn't.

You could be right. I swear I saw it though, but maybe I've just heard so much about it I dreamt it. But I seem to recall seeing a tape that showed Shelley Pearl Harbor Kolstad and then watch Nelson enter from the right side of the frame and deliver the kick. This was before charges had been filed, so there was probably a window of opportunity when the tape could be shown.

Calling it "drawing first blood"? Did Nelson have any injuries? I certainly don't see any described. Doesn't take superman to push over a drunk. If Kolstad's intention was to draw first blood why didn't he hit Nelson when Nelson was on the ground? Instead, Kolstad starts walking away and is motionless on the ground before Nelson gets back to him.

I agree completely. Let this damn thread die. This nasty example of a kangaroo court gone wild will just have to wait until this sad, sad story has it's day in court It will end the way it will end some day...but probably not for a long time. Please, GH: do not continue to enable this mockery of the nature, spirit of justice and the integrity of the justice system by continuing this name-calling, side-picking, "trial by message board" never ending trivialization of a "bastardization" of our most sacred and precious system of justice, the right to a fair trial and even the entire concept the right to a fair trial for all.

If Denny Green has taught me anything, it's that everyone is entitled to an opinion, but you certainly don't have to listen to it. If you have problems with people expressing their opinions about an ongoing legal situation involving a former Gopher, maybe you are better off not opening the thread.

I would agree with you accept there hasn't been a new opinion on this topic for a very long time. It is time to do the merciful thing and allow this string to die.

The last paragraph on page 2 clearly states that Kolstad attacked Nelson. Therefore, he should be charged. At a minimum it has to be a misdemeanor. People here seem to like to defend Kolstad, but no one has yet been able to explain why he shouldn't be charged.

Why is everything so dramatic and serious with you? Ever try just enjoying life? For example, me and a buddy will be hitting the opener in costume for a bit of fun. I'll be wearing my #9 Gopher jersey while pushing my buddy, who's wearing his #22 Mavericks jersey, in a wheelchair through the lots into the stadium. Where will you be? We can wheel by.
 

Well we can only hope the judgement of the Mankato Police investigators and/or more importantly the Blue Earth County Attorneys office is not as horrible and absurd in this case as it was when they handled the case of the head football coach.

I view anything those two govt. departments put on any document as suspect at this time, unless all directly or indirectly involved in the previous Hoffner case have been fired or resigned since that debacle. I'd have more faith what the tape actually shows, not much of anything that is put out by, or filtered through this group of clowns.

For those that want the thread killed, stop clicking the thread, and certainly stop posting in the thread. Problem solved. It looks like others want to continue the discussion, want updates, etc. Having it all in one thread certainly is better than new threads popping up.
