Trevor - TRIAL HEARING SCHEDULED FOR 06/07/2010

Without going into much detail, I have heard alot of grumblings about the legal advice Trevor has received and not alot of people locally have a very high opinion of his current legal representation and the way they have handled this case.

Well yea, pretty much everyone and their dog knows this. With all this supposed evidence to prove his innocence it shouldve been pressed into action a long long time ago, not worrying about dodson and friends

Unfortunately, NCAA rules prevent a lot of knowledgeable people who would like to help him pro bono from doing so.

My guess is that Trevor is not in a position to afford the best and brightest legal talent.

Royce does not belong on this team because he has had so many incidents over time. Has Trevor had other issues in the past? I haven't heard of any. For a guy that appeared to be a good citizen since the suspected incident isn't a year punishment enough. Even if it turns out he got drunk and punched someone in the face in Miami, missing all of last year should suffice.

Mbakwe has gone through schools (both high schools and colleges) like Dr. Don goes through a case of Blue Moon on a Friday night. It's obviously not a crime to transfer, but at some point you have to wonder why?!?!?!

Why? Ummmm...how about the crazy reason that his coach left his Marquette, and he didn't want to sit out a year? Art - don't even imply that transferring schools means he's done something wrong.

It's just like when people see my resume, they wonder why I had a short stint at my last job - but after they ask, they realized I was laid off. Many times, there's a good explanation as to why people do things.

As for chances of him playing, Hofferette - I'm going with 90%. At this rate, it may be when he's 38, but I hope/believe he will see the court. I really hope I am right on this...only time will tell.

Why did he wait so long to transfer? Mbakwe really hung Marquette out to dry by transferring right before school was about to start.

He has spent time in both Wisconsin and Minnesota. Maybe he is a Brett Favre fan.

"Missing all last year should suffice." I believe the victim had at least one surgery to repair her cheek bone. The victim might have permanent scarring from the surgery and is reminded of the assault every time she looks in the mirror. Tell the victim sitting out a basketball season is punishment enough for what has happened to her.

A plea bargain more then likely would be to agree on a shorter sentence for pleading guilty.

I hope Trevor isn't guilty but it sure raises flags how quickly Trevor left Florida after the assault.

I hope Trevor had nothing to do with this awful assault and goes on to have a productive time on the court with the Gophers, in the classroom at the U and in life generally.

His attorney is known more for going after cops for police brutality and civil rights violations than defending assault victims.

While him ditching Marquette doesn't point to guilt in a criminal matter, it may be revealing to some with respect to his character.

After Crean left, Mbakwe said hearing rumors that he would leave Marquette was a shock, not true.. the thought never had crossed his mind. Just before classes start, he dips out to 'go the JUCO route', which apparently was code for 'play for Tubby in Minnesota'. Transfers happen all the time - but when you do it in the manner Trevor did, it can be upsetting to some. To classify his departure from Marquette as the normal, "well, the coach left, so the kid left" does not jibe with what really happened.

There were whispers Mbakwe was considering transferring in the days following Tom Crean's departure for Indiana, but on April 16 he told the Journal Sentinel he would remain at MU.
"I've been reading the papers and they're saying all this stuff about me transferring for family reasons before Coach (Tom Crean) even left," Mbakwe said then. "I just want to let everyone know that isn't true. It was news to me. It was a shock. I didn't know where it was coming from, and that's never been an idea in my head. "

A 6-foot-7, 240-pound sophomore forward, Mbakwe would have begun the fall semester with his teammates this morning but instead remains in his hometown of St. Paul, Minn. Williams and the Golden Eagles, meanwhile, were caught completely off-guard by Mbakwe's decision -- especially since he took part in all of MU's off-season workouts and had given no indication he was considering leaving.

“He just said that he felt it was best to go the junior-college route," Williams said. "He had never told me anything. I only want people that want to be a part of our program, be a part of our institution and be a part of our family. I wish Trevor nothing but the best, and I know his teammates feel the same way. I was shocked by the news."

My understanding is that Mbakwe left Miami the morning after this incident is alleged to take place. While one article said he took summer classes 'to make the adjustment after spending last year at a junior college', I think he was actually taking online classes to complete his Miami-Dade requirements. In July, he commented about the rumors about him not playing at the U... A few weeks later, the news gets out about his felony arrest in April.

Mbakwe is taking summer classes to make the adjustment after spending last year at a junior college. Mbakwe played as a freshman at Marquette.

Mbakwe said that he was aware of the rumors about him not playing for the team this
"I know that people have been mentioning about me not playing, but is not true. I'm here. Nothing's changed

The suggestion that if he is guilty, not playing in games for one year is punishment enough is sick. He has had no punishment to this point - the reality is he was subject to an automatic suspension from team activities - Maturi had to take action in order to allow him to practice with the team and sit on the bench at home games this year.

Per the police report:
On April 3 at a Miami apartment complex, a party was being held for the Miami Dade College basketball team. A woman who lived at the complex was walking from her vehicle to her apartment shortly before 3 a.m. when a man rode up to her on a bicycle. She ignored the man, who ultimately dropped his bike, approached the victim and attempted to pull her pants down.
After yelling for help, the victim was hit twice in the face, suffering a fractured cheekbone and a ruptured sinus.

Trevor was set on transferring from Marquette long before Crean was courted by Indiana. Why do you think he decided to lift his redshirt late in the season??? Because he knew he'd likely have to sit out a year (redshirt) by transferring so he had nothing to lose by playing sparingly in Marquette's final 10 games or so that year. I'm not saying transferring schools implies any wrong doing (legally) but when a player transfers high schools 3 times and college twice in a span of 5 years, that should raise a red flag.

Some great speculation there. I hope that's a joke that you're considering going from MU to Miami to MN as transferring twice. That was basically the same as going from MU to MN.

Unbelievable but i agree with Art, the timing was not perfect but Marquette was hardly in the dark about Trevor's intentions. Trevor had approached MN earlier in the summer about transferring and it was far from a secret he didn't like playing for Crean

I know many on this board don't care for me and that's fine. However, I more plugged in than most people realize and I know how things work in college athletics.

He doesn't have a public defender defending him. This is Mbakwe's lawyer.

Honestly people ALWAYS assume because they are paying someone alot of money that they are getting a better attorney than a public defender. After all, since they are free and work for the state they must be bad right? Very wrong. I can say with certainty that many public defenders are much better criminal defense litigators than 99% of the private attorneys out there. They spend about a million percent more time in a court room in front of judges and juries than most private attornies. Also, they know the judges and system VERY well in the counties that they work. The main issue with public defenders is if they have the time to devote to each case since their workload is about three times the recommended bar association maximum. Trevor's best choice likely would have been someone who had worked for years as a public defender and now has an active criminal defense practice that specializes in defending felony cases.

This is just extremely frustrating and makes one wonder about prosecutorial abuse. No prosecutor worth his salt would go to trial on an eyewitness account. Mbakwe should have never been suspended. These charges should have been dismissed prior to the new year. I feel terrible for the young man.

Art, I have a problem with you saying Trevor had nothing to lose by playing 10 games for Marquette.
Let's say that Trevor doesn't come back to play during his freshman year at Marquette (he uses his redshirt). He goes down to Miami-Dade College for a year(which he did). Then transfers to Minnesota(which he did), by my calculations, he still would have had 3 years of eligibility left for the Gophers(1 year redshirt at Marquette + 1 year at Miami-Dade + 3 at Minnesota). Similiar to what Carter had when he transferred. What am I missing?

I think a fair percentage (20%?) of you get it. The rest are living in a fairy tale world. Pretty amazing post to read through, top to bottom. Scary.

How about you try and explain it in terms of picking up skanky drunk women at a party? That seemed to work really well last time.

1. Are you a attorney?
2. Are you privy to all of the evidence in the case?

If you answer is no to any of these questions then you probably shouldn't be making statements like you have.

The justice system in this country, particularly in southern states, has never been fair to African-Americans, especially those without the financial resources. No doubt if this happened some rich white kid at the Univ. of Miami, this would've been disposed of a long time ago.
