Then he shouldn't have told Mbakwe that he was leaning that way, and had to put the program 1st, and was getting a lot of heat for this. He could have just said, he needed more information, wanted to get all the facts, and decide. That would have saved Trevor (and all us) from a lot of freaking out.

The story wasn't written by Sports Illustrated. The story was from the Associated Press and was almost certainly written by one of their staffers in Minneapolis.

Maybe if there wasn't a rush to print with only an unnamed source there wouldn't be any freaking out either. Maybe your need to nail Maturi at every turn got in the way of finding out what was going to happen. Is their any quote on the record from Maturi that he was going to suspend him? A quick Google search, without the Gopherhole references doesn't show any.

The highlighted text below notes that the State's Attorney has yet to make a decision whether to proceed or dismiss. That could allow the school to wait as well until a decision is made regarding prosecution. Note that there is no mention in the story that Trevor sought a restraining order or that the court issued any restraints on the woman. There was a suggestion earlier that the court had issued a bilateral order directed at both parties.

A 22-year-old woman filed a harassment order against a University of Minnesota basketball player — which he reportedly violated this week — because he allegedly continued calling her when they broke up and she feared he would harm her.

The harassment restraining order against Trevor Mbakwe, 21, was filed June 29, 2009, in Dakota County District Court by his ex-girlfriend, who lived in Eagan at the time, according to the petition. The relationship ended in March 2009, she said.

The two-year restraining order bars Mbakwe from going to the woman's Eagan residence, her employment at a St. Paul restaurant, the American Red Cross Twin Cities Area Chapter in Minneapolis and St. Catherine University in St. Paul. Trevor Mbakwe was arrested and taken to jail Monday night after violating a Harassment Restraining Order. The order does not explain why the Red Cross and college are included.

Mbakwe allegedly continued calling the woman on June 19, 2009 after her roommate told him to never call her number again, the petition said. Mbakwe reportedly told the roommate, "White girl give (the woman) the phone." He later told the roommate he would harm her if she did not give his ex-girlfriend the phone.

His ex-girlfriend said in the petition that she feared "he could get violent and physically harm" her because of an outstanding felony battery case from the Miami-Dade County courts. She also stated that after the June 19 incident, the woman changed her phone number, but Mbakwe continued finding ways to contact her from other numbers.

The woman, who now lives in St. Paul, contacted St. Paul police Monday, saying that on Sunday, Mbakwe had posted a message on her Facebook page — which violated the restraining order, which was originally out of Dakota County.

On Monday, Mbakwe was arrested in Minneapolis for allegedly violating the restraining order. Police issued Mbakwe a citation for misdemeanor violation of the order before he was released from jail, said St. Paul City Attorney Sara Grewing.

The city attorney's office will be reviewing the case over the next couple of days to approve the citation or decline to prosecute, Grewing said. If Mbakwe is formally charged, he'll be due in court on Jan. 20, she said. (emphasis added by j35jazz)

The maximum penalty for a misdemeanor is 90 days in jail and a $1,000 fine.

St. Paul police contacted University of Minnesota police, who arrested Mbakwe at 3:30 p.m. at a home in the 1000 block of 29th Avenue Southeast in Minneapolis.

Walking out of Ramsey County Jail at 11:40 p.m., Mbakwe said he had no comment about the charge. His bail was set at $500.

If I was forced to bet how this will turn out, I'd put my money on him never playing again for Minnesota.

You can believe choose to believe me (and my source) or not. I believe them. I was simply relaying to you all what I found out, there is no source more reliable in this case. It's not the decision itself, but making it looked like he changed his mind or "dithered" when in reality there was no announcement except for the one saying no decision had been made. That couldn't contradict what he didn't officially say. Though now because of a leaky source, that's exactly what's happening.

You've said this twice now GW? Any reason that you think this, more than what's already been reported?

An objective look at the "facts" as I understand them... perhaps that's more than what has been reported, I haven't looked at much, but some of what I've seen is inconsistent with my understanding.

And I could live with whatever the program/school chooses to do. In August - and with respect to this I don't know what was said - if I'm Tubby and/or Maturi, I'm telling Trevor, "the suspension is now lifted.. but you so much as look at someone the wrong way... or flippin jaywalk on Oak St,... that is your a$$".

Time to start checking out academic calendars... but, to be clear, I have no idea what the U is thinking at this time, just stating how I would bet if I had to bet on how this will shake out.

Unfortunately I'm in the same boat at this stage. While this is a pretty minor infraction, it's still another blackeye on his image, and Gopher Basketball.

Is there anything in place stating that a player charged with a misdemeanor regardless of magnitude or lack thereof must be immediately suspended? Isn't the U free to make a call as to whether a suspension can be delayed pending review by the U? Please explain why the decision of the U is autmatically delayed here. I may be missing something.

There is no automatic stay. Trevor apparently was given a court order pursuant to a petition for a Harrassment Restraining Order, which is a civil petition filed by the woman. An HRO is a civil proceding. However, violation of the order may include criminal penalties. If the state decides not to pursue the matter, there is nothing that will rise to a criminal allegation much less conviction. If the state does decide to persue the matter, it is open as to what type of sanction the court might impose if it found Trevor in violation of the order. Sanctions could include criminal penalties.

The easy way out for the school is to hope that the state acts quickly and makes decides not to persue the matter which could occur, for example, if Trevor agreed to abide by the order and not try to contact the woman.

If the school acts first, they will have to guess what the outcome is going to be. If I were advising, I would suggest holding off any public decision at least for the very short term to see if a deal could be worked out where the state would not persue the matter and the woman would be assured of no further attempted contacts. That agreement could be made well in advance of the court hearing and perhaps in time to allow Trevor to play this week.
