Shocking... /s. This was nothing more than political grandstanding. The fact that the Strib dug around to find someone that would give them a quote to say otherwise is disheartening.
 

It's obvious that the prosecutors don't think the evidence holds up. Doesn't mean there won't be an equally messy civil suit that will tarnish the program a year from now.

Someone needs to tweet at Doogie why they put all 10 picture out there with a headline of assault. Gopherhole? You made progress with Shipley. I wish I could, but can't due to the nature of my work.

No charges. Does anyone have a good reason why the players shouldn't be reinstated?

Unfortunately there is still the matter of the involvement of an underage recruit. Don't know how that is going to come out in the wash.
 

I don't get the huge sigh of relief or ripping DA Attorney Freeman's quote. Thank goodness they won't be charged? Bad on the Star Tribune and DA Freeman to report and make a comment?

I believe in the burden of proof we put on the government in criminal cases, but I also feel that a code of conduct that goes with the privilege of being a scholarship athlete requires a higher standard of behavior than the criminal code. I get that my perspective my not be popular, especially after the victory this week, but I applaud the U for not trying to cover this up. If Antoine Winfield wants to be mad and bring his son home, see you later.

The code of conduct cannot violate the Constitution, other than that, I think we all agree with you.

As far as the burden discussion, the standard for bringing charges is probable cause. It is extremely common (status quo) to bring charges before you have evidence that could prove a case beyond a reasonable doubt. In situations like this, it is how you get people to talk. You arrest them (probable cause) and you file charges (probable cause) and you get people to start talking. I know some people on here are saying things like "the standard is so much higher in criminal cases", that's true. . . to convict. It's simply MUCH lower to arrest and file charges. Neither happened here.

university of minnesota might be the watershed case for an all out legal assault on title ix and eoaa-like orgs across the country if these expulsions/suspensions really go through after this.

you can rightfully say 'schools have different values and rulesets than the legal system' to which most rational people would respond 'well lets go about fixing that then'
 

Witch Hunt!! Still posting 10 players and naming it a sexual assault case then in article 6 were not involved but put there picture up with the 6 that were embarrassing!

I think that they probably gave it a real second look.

This case is under a microscope. I am not at all surprised it went the way it did, but I think if they had found something new or damning, they would have brought charges.
 

Beyond the alleged sexual assault you've got:
-contributing to the delinquency of a minor- serving him alcohol.
-videotaping a minor in a lewd act- enough for child porn?
-expressing lewd, derogatory comments using. a university web platform.

Just like Jan Gangelhoff. It's not that it doesn't happen at other schools, these guys got caught.

Yeah good point. Players are held to a higher standard. Just because no charges does not mean they wont get kicked of team.

Well, I really appreciate and respect your expertise in your postings of late, but I think you'd have to admit that a BIG part of the reason was for the appearance that they'd been thorough the first time...and somewhat reactionary due to the local exposure.....just in case they did miss something, which to me, would seem (in respect for Freeman) unlikely.

They got caught and they are going to pay the price for it. There is zero doubt about it.

No, I agree. I think that is why they felt compelled to take a second look. However, I don't think it was "just for show", I think they probably did re-examine the evidence. They know this is under a microscope and as bad as they would look filing charges at this point, they could look really bad if some really awful evidence was missed.

Put it this way, I agree with you. They felt politically pressured to give it a second look but I have little doubt they would have filed charges if they thought the case merited charges.
 



I said when it was announced they were going to take a second look that I could write what I thought happened on a cocktail napkin and it would be just as admissible in court as the EOAA report. That's no exaggeration. Maybe they wanted to see if there was any actual evidence in there they could find with other means but the method that investigation is allowed to happen makes everything in-admissible. Those looking to hang these players should think about why that is.
