Leach sues ESPN, PR firm for slander, libel


According to the article:

"Leach was fired a few days before Texas Tech beat Michigan State in the Alamo Bowl. Craig James was slated to be a broadcaster but was replaced by Dan Patrick, according to the suit.

Patrick described Adam James to “an audience of millions,” saying, “There is Adam James, who is the young man who was actually punished for having a concussion,” the lawsuit claims. Patrick’s comments left the impression that “Leach punished a player for having a concussion.”"

Hopefully the lawsuit doesn't actually claim that Dan Patrick filled in on play-by-play.
 

It seems he likes to sue. As far as the possibility of him becoming a football coach again in the foreseeable future, all he's doing is digging himself in further with all these lawsuits. You hear the word 'lawsuits' and it's pretty much a given that you should steer clear of a person like that. Some people are just born to sue, and it's wise to stay as far away from those type of people as you possibly can.

I'm Not Sure Leach's Career Is Over

Suing your former University & ESPN is career suicide.

At some point, Leach will come back from this "self destructive" period in his life.

It strikes me that Leach's strength is his weakness. He seems to have a massive chip on his shoulder, which can often translate into hard work, dedication, and the desire to prove everyone else wrong. All good things. The problem is that the same chip can make one prickly, defensive, and self-righteous. All bad things.

He probably needs to work through some issues, but there is no question that he knows how to coach.

What, you have something against somebody effectively using the courts to remedy a wrong? I guess you probably have said something like "the Constitution is good" and then condemn the first guy out of the shoot for using one of its main triads. Are you a closet fascist or socialist or something.

Talk about overkill on your part. Take some of the corporate crooks or corrupt politicians to court and throw the book at them instead of all this made for tv drama and publicity of Leach vs ESPN, Texas Tech and the world b.s.

Personally, I hope ESPN, the University, everyone else named and especially Leach ALL lose their cases. The courts should throw the whole thing into the circular file and tell all the parties involved to go out, grow up, not take themselves so seriously and to quit tangling up the court system with their petty charges and sentence them to sit in a corner for all being the way they are being. Their moms and dads didn't do a very good job raising them... : 0 )
 



I don't think suing ESPN is anywhere close to as much of an issue as suing TT is.

You are right. The only good thing to say is it is "American" to protect oneself with common law as applied in the courts. It is curious that those who say lawsuits are shrill voices in the wilderness are responding similarly to what Joseph Stalin or Mao. I also find it curious that you judge libel as an unjust and legal cause to bring a claim against the oh so upright ESPN. Why would any fair and balanced individual want someone to lose a case up front? Do you have issues with Leach? Or, is your opinion of justice so low that you find it meaningless, the good juror that you would be -- first to be dismissed and held in contempt by the courts. I could just imagine what a dear former teacher of mine, Judge Armstrong of Washington County would say to you with your indignation, "Son, I am the judge here. Are you telling me that the defendent over there doesn't deserve his day. Would you like to apologise to the court or spend some time contemplating your contempt!"

he doesn't "like to sue" the guy is fighting for his reputation. it is a lot different then just picking out any and everyone and taking them to court. in his time at texas tech how many law suits did he file? none that I'm aware of! leach is going hard trying to prove he did nothing wrong and I applaud him for that. leaders don't sit on their hands when people try and push them around. leaders push back and fight for what they believe in. leach will coach again and be successful and we willbe pissed off for passing up his resume when we are looking to fire bray hoke in 3 years.

why? his only lawsuits are with texas tech and espn! unless he has a reputation of going to court with previous employers like kentucky and oklahoma, which he doesnt, leaves me to be believe some of you are blowing this way over board. personally i would love leach to coach this team in the future, if not im not going to lose any sleep over it. but to say he is sue happy or destroying any reputation he still has is pretty dumb imo

He has a case. He is looking for a settlement from the University and from ESPN. I doubt it ever goes to court. They will pay to keep it out, because he has a case.

Why do you believe that Coach Leach "has a case"? Are you thinking that he has a case against the University itself. My understanding is that the individual defendants have been dismissed from the second TTU case, leaving only the University. I cannot see what he has done to overcome any of the defenses available to TTU, including sovereign imunity. It seems like the crucial count against the school comes down to whether Leach's refusal to cooperate in the investigation after being directed to by the president or chancellor is insubordination and therefore a sufficient basis for termination for cause. I think it is, but maybe I am missing some of the key facts. What facts do you think he can prove?

Also, have you read the complaint against ESPN? I have not. A little factual checking on the allegations being reported indicate that ESPN should be able to have the suit dismissed, but I have not seen the exact allegations. I would be curious to know the details of the allegations.
 


He is claiming that ESPN and some firm out of Dallas (the same firm responsible for the Kerry "swift boat" thing) were slanderous towards him in order to sway public opinion against him.

The case against TTU definitely has a shot of being successful. Lower courts have already ruled TTU does not have sovereign immunity in the case. It is now in appellate court.

I don't know if he has a case against either that he could actually win. I do know he has a case against both that he may be able to push far enough to get a settlement from ESPN, the Dallas firm, and TTU (which is what I believe he wants).
