Guys entering portal with seemingly no eligibility left

So, a sports agent indicated those with seemingly no eligibility left are entering the portal for 2 reasons; 1), just in case litigation occurs that permits additional eligibility, and, 2), as a negotiation tactic with actual "professional" teams to obtain a guaranteed contract while the litigation and chaos swirls around the basketball world. Eg. If you draft me in the 2nd round and give me a 2 way contract, i will waive my right to claim additional eligibility.

Makes sense to me.

It doesn't hurt anything I suppose, but I don't understand how they gain any leverage if a litigation doesn't occur permitting additional eligibility.
