If worried about the likelihood of athletes signing non-competes, why would they agree to buyouts that hurt?

Also, what does “make the buyout hurt” look like? Miami just paid $10 million to poach Mensah.

Are you sure about that? Pretty sure they are required to enter the portal prior to transferring. Why was no one transferring before the portal opened? Teams in the playoffs have an extended portal date, so not sure if that played into this since he originally signed with Ole Miss. Have we seen anyone else enter the portal from a non playoff team after the portal closed?
“While the 15-day transfer portal window closed Friday, Jan. 16, NCAA rules allow for a brief administrative window. As long as a player notifies their school in writing before the deadline, the program has up to two business days to formally enter that player into the transfer portal, with an increased processing timeline in this case because of the Martin Luther King Jr. Day holiday Monday.”
This explains some late entries.

I’m sure. Doesn’t mean the players know that. Unenroll at school A, enroll at school B. Jake Retzlaff did that this past summer and threw for 3168 yards at Tulane this season. Xavier Lucas played at Miami doing the same.

Can the NCAA prove tampering? Not without a lot of help.

Again, I’m not opposed to specific and defined consideration in contracts and yeah, the court may find in Dukes favor here. I think it’s a ludicrous argument to argue irreparable harm when Mensah did not have anything to do with a) the anti-competitive transfer portal or b) Dukes’ failure to recruit and retain an adequate number of quarterbacks or c) insert a defined buyout clause but I’ve been around long enough to know not everyone agrees with how I see things.

Retzlaff walked on at Tulane so he wasn’t even on scholarship, I don’t imagine many pull this move. Lucas was able to navigate his transfer with help from a lawyer, but he attempted to enter the portal, but Wisconsin blocked him from doing so. We might see a few try to pull similar moves, but I don’t think we see a second wave in the spring like in the past.

I read they (Tulane) didn’t have a scholarship to give but you could be right. However, I don’t really see why they wouldn’t be able to offer him a scholarship after he “walked on”. In any event he didn’t have to sit out a year.

Lucas was also able to enroll and play. Wisconsin alleges Miami tampered. Case is AFAIK still unresolved. It won’t distract Badger fans from the McIntosh/Fick disaster unfolding in Madison. They should probably start saving their cash now?

There will definitely still be some roster movement between now and the start of the season but it almost certainly won't be to the degree it was when there were 2 portal windows.

As for all the tampering and other BS going on.........at this point the time between the end of the season and the start of the next one should just be dubbed as the legal season while all this crap gets sorted out in the courts.

Likely the key point in the current college football NIL/Portal/Etc. universe. Right now, there does not seem to be any kind of solid hierarchical structure that can fully address the complications that are arising. It's pretty much a horizontal system with--using economic terms--barriers to entry into the market for some of the consumers in terms of procuring talent. That was probably true to a somewhat lesser extent pre-NIL/Portal as the helmet schools clearly had at least a perceived and likely a tangible advantage.

The questions are where is order going to come from and, frankly, is there a desire for order on the part of both the talent and the procurers of talents. Power abhors a vacuum and there clearly is a vacuum here. I am just wondering what entity or entities will attempt to fill this vacuum. The power to define is--at least to me--the ultimate power on this side of the line that separates physics from metaphysics. I am curious to see who, if anyone, steps forward with suggestions for a concrete solution to the current chaos.

Walk on vs scholarship is kind of obsolete with the roster minutes being the new rules

But it’s kind of a rolling transition with many guys grandfathered in
