I agree. I did a search for his case yesterday and the December trial date was still there.

Let's hope for the best then I guess.

"A hearing is generally distinguished from a trial in that it is usually shorter and often less formal. I would say also in the recorded information in his case is that there have been a number of hearings that are labeled as such.

I would assume ( I hope ) that it's happening and the result will be recorded today.
 


This is not a trial. Probably a status hearing. Maybe the court will hear some motions, e.g. excluding certain evidence. Or maybe they'll talk about scheduling. Will be interesting to see if the defense atty or the prosecutor tries to push it back. Also, I had heard Mbakwe was asking for court assistance to fly in his witnesses (bb players now out of state) so that might also be what it's about.
 

Considering the hearing was asked for just yesterday I expect that the defense is asking for a new trial date. Either earlier, so if found not guilty Trevor can play more this season, or later so Trevor can just sit out the whole year and not have to deal with this mess mid-season.
 



This is very interesting. The case information conflicts a bit as to whether there is a hearing or trial taking place today. The Docket Report (which lists case filings by the attorneys and the court)--as shown in Blizzard's message above and on the court website--says that there was a "report" yesterday that sets trial for today ("11/02/2009 REPORT RE: TRIAL DATE SET FOR 11/03/2009 AT 09:00"). The case information page, on the other hand--as shown in centerofmn's message above and on the court website--says there is just a hearing today.

This is very interesting -- the only way to find out would be to call the court and see if a clerk will interpret the docket report for us or tell us if there is a trial going forward today on this case. Any takers? Or we could just wait a day or two and see what gets reported in the news, from Trevor, or on the court website.
 

I called my brother yesterday and said that I'd bet Mbawke's attorney is going to try and push up the trial. That is exactly what this hearing is. "Report RE: Trial Date" means they had a hearing this morning about trying to alter the trial date. IMHO, it would be silly to push the trial date until after the season because if he is convicted he won't be playing for the Gophers regardless and if he is found innocent, he could still get on the court this year.

This means there is a report (or hearing) today on trying to push his trial up. I used to work in the docketing department of a law firm, and we dealt with this stuff constantly.

Lol. I've gone so far as to check the Judge's calendars for today. I didn't see the Judge trying his case though as being listed.

There's a video on Star Trib where Tubby addresses the Trevor issue. He says that Trevor hasn't been to the last 2 team practices. Hopefully, Trevor is still going to class and I hope he sticks through with his commitment to the program. I also hope that he realizes, that with his current circumstances, there are probably very few schools who would take him.

Trevor - Let's get this done ASAP and come help the team this year!

If the trial date is going later, not sooner, things don't look good. You have to question whether he really has any chance to play this year, and really if he'll ever end up lacing them up for the Gophers at all...

that might explain why tubby said he hasn't been able to attend the last couple practices. in miami taking care of legal stuff.

it would be sweet if someone (who knows how to go about it) can find out more about judge bertila soto. what is her track record? does she have any history trying cases like this? is she one of those judges that is willing to listen to all sides? or does she seem prone to always side with the plantiff in cases she hears?

Yes Bronko, the whole world is out to get Gopher athletes, even judges in far-away Florida.
