We've entered into the silly portion of the search process where every day there is a new report or tweet about a coaching candidate. May I respectfully suggest that 99% of these reports are pure silliness. Unless Maturi is blowing a smoke screen, here's what we know from what the leader of the search has just said:

(1). Two new candidates were just added to the list. Does that sound like he's already scheduled an interview with the Navy coach or anyone else?

(2). He's trying hard not to "fall in love" with any one candidate just yet. Does that sound like Tubby and Dungy are out there trying to get Fulmer to commit to the Gophs?

(3). Maturi does have some favorites on the list. Note that "favorites" is plural. Does that sound like they've zeroed in on any one candidate? He also said that they have yet to determine if some candidates have as much interest in the Gophers as the Gophers have in them. Sounds to me like they are just getting to the point where they start weeding down the list.

(4). If there is a potential Tubby hire out there, will they really be lining up interviews with second tier candidates? Is there any indication from Maturi that they are ready for interviews?

Some reports are about the search firm digging around certain names. Gee, I think they are doing that with every single possible candidate - even someone like Harbaugh. Other reports make little sense, such as Sumlin is investigating how much he could pay his coordinators. If he was already a serious candidate, wouldn't he just ask or look on the web to see the current salaries?

Reporters want to look like they have some kind of insight or connections that others don't. Web sites want to increase their traffic any way possible. Coaches or their agents want to get their names out there for various reasons. Hence, there is probably little truth to anything we are hearing right now.

When we hear a report that the Gophers have asked permission to speak to a candidate, that kind of report will merit attention. Until then, when you read the next report or tweet view it with skepticism unless you see at least some attribution to the story. So far, none of these reports have even bothered to claim "according to a reliable source at ..." or "mutiple sources have confirmed..." They're just throwing stuff out there. Anyone on GH could do the same. So, don't get your undies in a bundle when you read the next rumor because that's all it is.

This is one reason I wish they would hire sooner rather than later but I know that a rushed hire is not in the longterm best interest of the program. It would be awesome to leak or officially announce the hire before the Iowa game so that the atmosphere of that game was less like a funeral for Gopher fans, plus it would be nice to get some good pub from the announcers.

I think it would suck if someone we really could use (Belloti/Leach/Fulmer, etc) ends up getting snatched up at the end of the season when another vacancy opens up. We should make a move before everyone else does unless behind the scenes Maturi has already chosen a candidate but they're currently coaching & can't announce it until the season is over...

A question for the board. My understanding is that Maturi can't approach a current coach without first asking his AD for permission. However, if the coach approaches him then talks are ok. Is this true? Secondly, are hires announced before the season expires? For example, next Tuesda hs

Jim Harbough approaches Maturi and they agree to terms in that first conversation (not a real chance, I know). Do they announce it or wait until after the season? What's happened in the past with other teams?

You better just hope Michigan doesn't go belly up down the stretch and they can Dick Rod....

They are leaks. Some have more significance and truth to them than others. No one said we are close to announcing a HC candidate.

We've been on the other side of this before (i.e. Brewster to Kansas in 2009). Once a guy starts returning phone calls from search firms and asking people theoretical questions his interest is going to be reported somewhere online. On the flip-side, it many be reported even if he doesn't do any of that.

ncgo4, in another thread I asked the same question you just did and I was told that the Gophers could flirt with the coach through the search firm, then the coach was free to ask for a dance. However, Maturi just said that they would ask for the necessary permission to talk to the coach, so I'm not sure what to believe. Maybe he'll still ask for permission when discussions begin to get serious on both sides.

Goldmember, I just don't see any evidence that anything we've read or heard so far is a leak. Something obviously happened with Fulmer - sounds like we told him we have no interest - but if Maturi is to be believed, we haven't gotten to the point where there is anything to leak. IF everyone does their job correctly, I don't think there will be any real leaks until things get fairly serious with one or two candidates. If you've just made up your list and you are doing background checks, research, etc., there's no real news to leak. At the most, who's not on the list.

I don't think there will be any formal interviews if the Gophers land a sitting head coach. The coach will be offered the job and accept it likely before his current A.D. even knows what's going on. I would guess that many of the names we've heard most frequently for this job are guys that WANT their name out there for one reason or another. I would also guess that most of these guys are on the second tier (at best) of what will become the Gophers wish list.

I hope we don't hear anything concrete about the search until the University has an announcement to make. That would be a sign that the search was done in the right way and we likely landed someone we can be excited about.

Tortious Interferance and Restraint of Trade

I answered this before. Here is an expanded view. The U has the right to compete. It knows a potential remedy by hiring somebody else's contract employee that can offer them the right skills, knowledge and ability to assist them in competing and raising their performance. There are tests to see if their is a tortious interferance claim -- the hey, you stole our secret weapon of competition claim. The defense against that is you do not employ wrongful means to procure the breach because your purpose is, at least in part, to advance your interest in competing with the other employer. The defense of fair competition is only available with respect to claims brought by a competitor and, again, applies to agreements that are terminable at-will.

Fair competition means that, if the employee answers a job posting for an opening and is the best qualified employee without regard to his or her employment by your competitor, you may fairly compete with your competitor by hiring the employee to engage in your normal business activities. However, if you use improper means or have an improper motive, such as obtaining secrets such as formations that guarantee first downs or unfairly obtaining your competitor's recruits, you will probably not be able to establish a fair competition defense.

Just to make it more complicated, if the coach is truly under a contract with limits to the length of his employment, he is an independent contractor and can seek out other contract opportunities without restraint. I would suspect most coaches are truly contract employees as "independent contractors" and not true employees. In which case, who gives a damn if the other school wants to prohibit discussions or not. They would be restraining trade and we would have the clear upper hand. As long as Maturi and Company do not seek out candidates with the best formations or secrets to recruiting champion athletes, the U can talk to whomever it pleases about this opportunity. This is not legal advice and the U or anyone else should consult with their own attorney on matters of law.

BING! Next coach whoever it is, is currently coaching. Nothing will come out until their regular season is over.
