if this was through a wall or something then I would have to say this is ridiculous...she should be countersued for noise violations and disturbing the peace. For me, the cell phone would have had to been planted in the room for this exact purpose in order for her to win and if the sexual encounter occurred in a common room then it should be thrown out all together. This seams to me to be an over reaction from everybody here.
 

I think the school is putting her at some fault because she had sex with a guy while his roommate was sitting right there...

The article left out an important part...she was a grad student and a TA, the guy she was sleeping with was in her class. That is why the school said her actions were also "inappropriate", the CBS article tried to make it seem like the school said her having sex was inappropriate, but that's not the case (I believe).

As far as the recording part, I agree with t-docious. If someone comes into my home and is so loud that I can hear them in the common area / my own room, I can record whatever I want. If he planted a phone, that's a totally different story

List of things I never wanted to see but sadly happened to see on a number of occassions...my college roommates having sex. Why the hell would I tape it? Ugh...things are much different today with YouTube and cell phones and social sites. Privacy and decorum are dead.

It's not nearly as bad as you think it is. It's just that when it happens EVERYONE hears about it.

It was just a normal part of college, especially in the dorm life. I remember playing MarioKart with a buddy in my room while my roommate and his "company" were doing their thing. When they were done, he hopped down from his bunk and got into the Star Cup.

I meant the recording part, not the sex around roommates stuff.
